capital partners AG processes the following categories of your personal data as part of the management of investor matters: contact details (eg name or e-mail address), information about your shares (eg number of shares, type of shares) and information about general meetings (eg the list of participants of a HV, which also contains your name if you participate).

capital partners AG only processes the personal data that is required to fulfill the legal obligations under the German Stock Corporation Act and other laws. This data processing is permitted in accordance with Article 6 (1) (c) of the General Data Protection Regulation (GDPR).

Personal data relating to you will not be passed on to third parties. Exceptionally, third parties also have access to this data, provided they are accessed by the capital partners AG to provide services related to the management of investor affairs. These are auditors, consultants and general meeting service providers.

The service providers receive personal data only to the extent that is necessary for the provision of the service.

The personal data of the person concerned will only be passed on or transmitted to third parties in cases other than those described in this information if:

the data subject has given his express consent in accordance with Art. 6 Para. 1 Sentence 1 Letter a DS-GVO,
the transfer according to Art. 6 Para. 1 S. 1 Letter f DS-GVO is necessary for the assertion, exercise or defense of legal claims and there is no reason to assume that the data subject has an overriding legitimate interest in the non-transfer of his data,
there is a legal obligation for the transfer according to Art. 6 Para. 1 S. 1 Letter c DS-GVO, as well as
this transfer is permitted by law and is required according to Art. 6 Para. 1 S. 1 Letter b DS-GVO for the processing of contractual relationships with the data subject.

Within our company, those persons who need the data to fulfill our contractual and legal obligations have access to the data of the person concerned. Processors, service providers and vicarious agents (subcontractors) and advertising partners used by us can also receive data for these purposes if they comply with our data protection instructions.

Recipients can also be public bodies if there is a legal or official obligation.

We use contract processors in particular for our advertising analysis services, server hosting services and for document destruction and sending our newsletter.

The above data will be deleted when they are no longer necessary to fulfill legal obligations and no statutory retention period applies.

The list of participants in a general meeting is only deleted two years after the end of the general meeting, certain powers of attorney only after three years.

You have the right to receive the personal data that has been stored about you free of charge upon request.
In addition, you have the right to have incorrect data corrected, the right to request the restriction of the processing of data that has been processed too extensively and the right to delete personal data that has been processed unlawfully or stored for too long (unless there is a statutory retention obligation and there are no other reasons according to Art. 17 Para. 3 GDPR).
In addition, you have the right to transfer all of the data you have given us to us in a common file format (right to “data portability”).
